Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") defines the rules and guidelines for using OmenHosting services. All customers must comply with this policy. Violations may result in service suspension or termination without refund.
2. General Principles
You are responsible for all activity on your server and account. This includes content hosted, files uploaded, and any services you run. If you did not authorize an activity, it is still your responsibility to secure your account against unauthorized access.
3. Prohibited Content
You may not host, store, or distribute content that:
- Violates any applicable law or regulation
- Infringes on intellectual property rights (copyright, trademark, trade secrets)
- Contains malware, viruses, worms, trojans, or other malicious software
- Contains phishing pages or credential harvesting tools
- Contains spam, unsolicited advertising, or bulk messaging tools
- Hosts or distributes child sexual abuse material (CSAM) — zero tolerance, immediate report to authorities
- Promotes violence, terrorism, or illegal activities
- Contains hate speech or harassment targeting individuals or groups
- Distributes personally identifiable information (PII) of others without consent (doxxing)
4. Prohibited Activities
You may not use OmenHosting services to:
- Launch DDoS attacks or participate in denial-of-service activities against any target
- Perform port scanning, network probing, or vulnerability scanning of systems you do not own
- Attempt to gain unauthorized access to any system, account, or network
- Operate open proxies, open relays, or anonymizing services for malicious purposes
- Mine cryptocurrency using allocated server resources (unless explicitly authorized by your plan)
- Run IRC bots or services commonly associated with abuse
- Host game servers for purposes of cheating, botting, or exploiting other game services
- Impersonate OmenHosting, its staff, or other users
5. Resource Usage
Each hosting plan includes specified CPU, RAM, and storage allocations. You must:
- Stay within your plan's allocated resources
- Not run processes that monopolize CPU or I/O to the detriment of other tenants
- Not use storage for purposes unrelated to your hosted service (e.g., file sharing, mass downloads)
- Not run background processes or services not related to your game server
Fair Usage: OmenHosting uses shared infrastructure. Actions that degrade performance for other users are prohibited. We reserve the right to limit or throttle resources that exceed expected usage patterns.
6. Network Abuse
You may not:
- Spoof IP addresses or TCP/UDP headers
- Engage in IP fragmentation attacks
- Use network facilities to bypass access controls of other systems
- Run network amplification services (DNS, NTP, memcached amplification)
- Participate in botnet command-and-control activities
7. Email and Messaging
If your service involves email or messaging capabilities:
- You must comply with CAN-SPAM, GDPR, and other applicable anti-spam laws
- Opt-in consent is required for bulk email sends
- You must include valid unsubscribe mechanisms
- Mass unsolicited messaging is prohibited
8. Minecraft-Specific Rules
For Minecraft servers hosted on OmenHosting:
- Servers must comply with Mojang's EULA
- Cracked/offline-mode servers that facilitate piracy are not permitted
- Plugins and mods must not contain malware or backdoors
- Servers must not be used to distribute pirated content
- Lobby/fallback servers that intentionally crash or corrupt client connections are prohibited
9. Reporting Violations
If you become aware of a violation of this policy, please report it to us via our Discord server or support page. Include:
- The specific server or account involved
- Description of the violation
- Any supporting evidence (screenshots, logs, URLs)
We will investigate all reports and take appropriate action.
10. Enforcement
Violations may result in:
- Warning: For first-time or minor violations
- Resource Throttling: Temporary limits on affected resources
- Suspend: Temporary suspension of your server pending investigation
- Terminate: Permanent removal of your service for serious or repeated violations
- Account Closure: Termination of your entire account and all associated services
Serious violations (e.g., DDoS attacks, CSAM distribution, malware hosting) result in immediate termination without warning.
11. Appeals
If your service is suspended or terminated under this policy, you may appeal the decision by contacting us through support. We will review appeals within 5 business days.
12. Changes to This Policy
We reserve the right to modify this AUP at any time. Material changes will be announced via email or our website. Continued use of the Service after changes take effect constitutes acceptance of the updated policy.
