1. Acceptance of Terms

By accessing or using OmenHosting ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and customers of OmenHosting. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Eligibility

You must be at least 13 years of age to use OmenHosting. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Services

OmenHosting provides game server hosting services, primarily for Minecraft. Service features, specifications, and pricing are subject to change without notice. We do not guarantee uninterrupted or error-free service, though we strive for maximum uptime.

5. Payments and Billing

5.1 Pricing

All prices are listed in USD. Prices are subject to change with 30 days' notice. Existing customers will be notified of price changes before their next billing cycle.

5.2 Billing

Services are billed on a recurring basis (monthly or annually, depending on your plan). By subscribing, you authorize OmenHosting to charge your payment method at the start of each billing period.

5.3 Failed Payments

If a payment fails, we will attempt to process the charge again within 48 hours. If payment cannot be collected, your service may be suspended after a 7-day grace period.

6. User Content

You retain ownership of all files, configurations, plugins, and data ("User Content") you upload to your server. OmenHosting does not claim ownership of your User Content.

You are solely responsible for maintaining backups of your User Content. We perform automated backups but do not guarantee their completeness.

7. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Distribute malware, spam, or phishing content
• Attempt to gain unauthorized access to other systems or accounts
• Exceed resource limits in a way that degrades service for others
• Resell or redistribute OmenHosting services without authorization
• Engage in activities that violate our Acceptable Use Policy

8. Termination

You may cancel your service at any time through your control panel or by contacting support. Upon cancellation:

• Your server will be shut down at the end of the current billing period
• Data will be retained for 14 days, after which it is permanently deleted
• No partial refunds are issued for unused time (see Refund Policy)

We reserve the right to terminate or suspend your service immediately if you violate these Terms or the Acceptable Use Policy.

9. Limitation of Liability

To the maximum extent permitted by law, OmenHosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities.

Our total liability for any claim arising from the Service shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless OmenHosting, its owners, operators, and affiliates from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect existing customers.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation before pursuing other remedies.
